Regulations of the online store operating at https://quarelli.com/ run by Quarelli Sp. z o.o. with its registered seat in Wrocław at 61A Nyska Street, registered in the Central Register of Business Activity, holding NIP No. 8971869986 and REGON No. 384166065.
1. PRELIMINARY REGULATIONS - DEFINITIONS
Whenever these regulations refer to:
1. electronic mail address - it should be understood as the designation of the data communications system that allows communication by electronic means.
2. personal data - should be understood as any information concerning an identified or identifiable natural person processed by the Seller for the purpose of proper provision of services electronically and sale of Goods at a distance as specified in these Regulations.
3. electronic form - it should be understood as a form filled out by the Orderer to place an order.
4. registration form - a form filled out by the Orderer in order to create an Orderer's Account.
5 Orderer's account - it should be understood as a place on the server made available by the Seller's online store, after registration by the Orderer, to which the Orderer gains access after logging in, allowing the collection and modification of personal data and placing orders.
6. the Ordering Party - it shall be understood to mean a natural person, a legal person, an organizational unit which is not a legal person and to which the law grants legal capacity, who is also a service recipient within the meaning of Article 2 point 7 of the Act of July 18, 2002 on the provision of services by electronic means (Journal of Laws 2013, item 1422, as amended), making an offer to conclude a sales contract.
7 Regulations - it shall be understood as these Regulations of the Seller's online store.
8. the Seller - it should be understood as Quarelli Sp. z o.o. with its registered office in Wrocław, 61A Nyska Street, having Tax Identification Number (NIP) 8971869986 and Business Identification Number (REGON) 384166065.
9. Store Website - means the websites under which the Seller operates the Online Store, operating in the domain www.quarelli.com.
10. merchandise - it should be understood as products available in the Seller's Online Store.
11. contract - a contract of sale of Goods located on the website quarelli.com concluded remotely by means of electronic communication - the Internet - when the Seller confirms the acceptance of the order. The contract of sale concluded with Buyers - consumers constitutes a contract concluded at a distance within the meaning of the Act of May 30, 2014 on consumer rights (Journal of Laws of 2014, item 827).
12. Service - a service provided by the Seller to the Buyer through electronic communication devices.
13. order - a declaration of intent of the Buyer addressed to the Seller via electronic communication devices specifying the scope of services to be provided to him by the Seller.
2.1 The Regulations set out the rules for shopping in the online store quarelli.com. Placing an order is tantamount to agreeing to all provisions and information contained in the regulations as they are in effect at the time of placing the order.
2. GENERAL PROVISIONS
2.2 The customer is obliged to familiarize himself with the content of these rules and regulations and is in any case bound by their provisions at the time of ordering.
2.3 Regulations are subject to change. Any change will be published on www.quarelli.com under the tab Regulations.
2.4 The sales contract is concluded between the Purchaser and the Seller.
2.5 The contract of sale of goods is concluded in accordance with Polish law.
3. RULES FOR MAKING PURCHASES
3.1 The online store located at www.quarelli.com is used to make purchases of selected products from the Seller's offer.
3.2 Purchases in the Seller's online store can be made only by adults. The basic condition for the realization of purchases made is the correct completion of the order form at www.quarelli.com and determination of the form of payment and sending the order.
3.3 Prices posted on the pages of the store are only an invitation to submit offers within the meaning of Article 71 of the Civil Code and do not constitute an offer within the meaning of Article 66 of the Civil Code. The presented product catalog does not constitute an offer within the meaning of the Civil Code, and is for informational purposes only.
3.4 The purchaser, after selecting a particular product or products and placing them in the Virtual Cart at the time of wishing to order the selected goods, should register in the store system by completing the registration form with the data necessary to complete the above-mentioned order.
3.5 Acceptance by the Online Store of each order placed is confirmed by e-mail or telephone by the Online Store staff. The conclusion of the contract of sale occurs at the moment of confirmation of the order by the Seller.
3.6 By sending an order, the Purchaser declares that he/she is familiar with the content of the Regulations of the store, in particular with the possibility of withdrawal from the contract, in accordance with the Act of March 2, 2000 "On the protection of certain consumer rights and liability for damage caused by dangerous products", (Journal of Laws 2000 No. 22, item 271) and accepts its provisions.
3.7 The Online Store accepts orders 24 hours a day on all days of the year. Orders placed on Sundays and holidays will be processed on the first working day following the day on which the order was placed.
3.8 Prices quoted in the online store are in Polish zloty (PLN) and include VAT. The Seller reserves the right to change prices without prior notice to the Customer, with the proviso that price changes do not apply to orders that are in the course of execution. The price listed next to each item is binding at the time the customer places an order.
3.9 The seller shall issue a sales document, which is a VAT invoice.
3.10. Placing of an order by the Ordering Party is tantamount to authorization of the Online Store www.quarelli.com to issue an invoice without obtaining the Ordering Party's signature.
4. FORMS OF PAYMENT AND PRICES
4.1 The purchaser has the option to make payment:
1) By payment by bank transfer - after the payment is credited to the Seller's account. information about the receipt of funds will be sent, which is equivalent to the transfer of the ordered goods for shipment.
2) Through payment to the courier - cash on delivery - after making the order, the Seller sends information about the completion of the order and informs about the date of shipment of the consignment as well as the amount to be transferred to the courier to pay for the ordered goods.
3) By payment in cash upon receipt of the goods at the Seller's point of sale by appointment.
5. TERMS OF DELIVERY OF GOODS
5.1 The purchaser in the process of ordering goods can choose the following forms of delivery according to the following scheme:
a) delivery via courier company
b) personal collection at the Seller's point of sale
5.2 The processing of the submitted order consists in:
(a) verification by the Seller of the completeness of the data sent,
b) contacting the Ordering Party electronically or by phone to confirm these details and the quantity, type and price of the ordered goods.
5.3 If the information submitted by the orderer is found to be correct, his order will be finally accepted, and he will be notified by e-mail.
5.4 Once an order is finally accepted, it can no longer be modified.
5.5 Final acceptance of the order means that:
a) the ordered goods are sent to the orderer in case of payment in cash (cash on delivery)
b) in the case of payment by electronic or traditional transfer, the goods will be shipped on the day the payment is credited to the Seller's account in the amount of the order.
5.6 The Online Store Seller reserves the right to reject incorrectly or partially filled order forms (in particular, incorrect e-mail address, telephone number).
5.7 When an order is rejected, the order will be canceled and the personal data contained therein will be deleted from the store's database.
5.8 When the shipment is handed over to the courier, the Ordering Party receives an e-mail informing about this fact and about the form of shipment being carried out and the order number.
5.9 The expected delivery time is 5 working days.
6 ADVERTISEMENTS
6.1 If the Ordering Party finds defects in the goods after receiving them, the Ordering Party shall send back the defective product to the address: Quarelli Sp. z o.o. 61A Nyska Street, 50-505 Wrocław.
6.2 The store does not accept shipments sent back cash on delivery.
6.3 The advertised goods must be accompanied by a Complaint Application together with the document of purchase of the goods. The complaint should include a description of the defect in the goods and the date on which the defect arose.
6.4 Complaints are processed no later than 14 days from the date of receipt by the store of the shipment with the advertised product.
6.5 In the case of a justified complaint, the damaged goods will be repaired or replaced with another, full-value one, and if this is no longer possible (e.g.: due to out-of-stock), the store will return to the buyer the equivalent of the price of the product or offer him other goods available in the store to choose from.
6.6 Complaints about mechanical damage caused during transport of the package will be considered only on the basis of the complaint protocol written with the courier. The product should be sent back to us together with the received sales document and justification of the complaint. We do not accept shipments sent back to us cash on delivery.
7. RETURNS OF PURCHASED GOODS
7.1 In accordance with Article 27 of the Law of May 30, 2014 on Consumer Rights (Journal of Laws of June 24, 2014, item 827), the Purchaser may resign from the goods purchased in the store without giving a reason within 14 days from the date of delivery. This does not apply to custom-made products. Paints and plasters tinted with the help of a mixer for individual order are not subject to return.
7.2 If you decide to withdraw from the contract, the Consumer should send a completed and signed statement within 14 days from the date of delivery of the goods, while the return of the goods with the purchase document and statement should be made within 21 days.
7.3 The cost of returning the goods shall be paid by the purchaser.
7.4 Returns are allowed only for goods:
1. not used (not bearing any signs of use),
2. originally packaged, if the goods came in a package,
3. not otherwise damaged,
4. complete, i.e. including all components if any are included with the product,
5. ordered at the base.
7.5 If all the aforementioned conditions for the return of goods are met, a refund in the amount of the price of the returned goods (delivery costs are not refunded), will be made immediately, by crediting the payment card account or, in the case of electronic transfer, the bank account used in the earlier purchase transaction of these goods, or by making a transfer by the Seller to the account indicated by the Purchaser, if the earlier payment for the goods was made in cash or cash on delivery.
8. DATA PROTECTION
8.1 Filling in the data in the order form is tantamount to consent to the processing of the Orderer's personal data by the Seller (in accordance with the Act of August 29, 1997 on the protection of personal data, Journal of Laws. No. 133, item 883.). The Orderer's personal data will be processed solely for the purpose of processing the order placed, including invoicing and financial reporting, as well as informing you about new products and promotions in our store. This data is confidential and will not be disclosed to third parties.
8.2 The Ordering Party's personal data protected in accordance with the Law on Personal Data shall not be transferred, resold or lent to other persons or institutions for purposes other than those related to the execution of the order.
8.3 Only the administrator of the online store has access to personal data.
8.4 Each Ordering Party shall have the right to inspect its data, to correct it and to file a request to stop using it for the purpose of order processing.
9. FINAL PROVISIONS
9.1.The Seller reserves the right to:
(a) changes in prices and quantities of goods on offer in the online store on a daily basis,
b) withdrawal of individual products from the offer of the online store,
(c) in the case of ordering more than one item to make delivery in several batches, and the shipping fee will be charged only once.
9.2 In matters not covered by these Regulations, the provisions of the Civil Code and the Law on Personal Data Protection and Consumer Rights Protection shall apply.
